[40] In this case the fact that blood was seen coming from Mr. Hogue's nose and eye does not satisfy me that there was a breaking of the skin which the narrow definition of wounding requires. It has been held by at least one appellate court that breaking an eardrum constitutes wounding. I refer to R. v. Littletent, 1985 ABCA 22 (CanLII), (1985) 17 CCC (3d) 520 (Alta. C.A.). In the present case the paramedic testified Mr. Hogue was bleeding from his ear but the medical evidence does not satisfy me beyond a reasonable doubt that the bleeding from the ear resulted from the stomping or kicking and not from Mr. Hogue's head striking the pavement.
