[18] As a result of s. 662(6), it is clear that an offence under s.348(1)(a) is included in an offence charged under s. 348(1)(b). It is settled law in this province that the offence of being in a dwelling house with intent to commit an indictable offence under s. 349(1) is an included offence in an indictment charging breaking and entering with intent to commit an indictable offence under s. 348(1)(a): R. v. Miller, reflex, [1948] 1 W.W.R. 1093, 91 C.C.C. 270 (Alta. S.C. (AD)). As an offence under s. 349(1) is included in an offence under s. 348(1)(a) and an offence under s. 348(1)(a) is included in an offence under s. 348(1)(b), it follows that an offence under s. 349(1) is included in an offence under s. 348(1)(b).
