Re-examination of Stephen Greene, Re-cross-examination of Stephen Greene

 

[46]      The Law of Evidence in Canada, supra, describes the purpose of re-examination as follows (at p. 879):

 

 

“The purpose of re-examination is to enable the witness to explain and clarify relevant testimony which may have been weakened or obscured in cross-examination. The witness is not ordinarily allowed to supplement the examination-in-chief by introducing new facts which were not covered in cross-examination. The general rule is that re-examination must be confined to matters which arose out of cross-examination. The right to re-examine, however, extends to rehabilitation of the credibility of the witness which may have been impaired in cross-examination. This includes the right to ask the witness to explain or clarify discrepancies between the witness’ evidence-in-chief and in cross-examination. In addition, this may entail the introduction of a previous consistent statement to rebut the suggestion that the witness’ evidence was a recent contrivance.”
