[42] A witness may refresh his or her memory from previous evidence given by them. Reference Re. R. v. Coffin (1956), 1956 CanLII 94 (SCC), 114 C.C.C. 1 (S.C.C.) at pp. 19 and 22.
[43] In The Law of Evidence in Canada, (Toronto & Vancouver: Butterworths, 1998), the authors set out the procedure for refreshing the memory of a witness (at p. 933):
“A witness who is called to testify and who wishes to refer to the record for the purpose of refreshing memory, should request permission of the court to do so. Counsel calling the witness should lay a foundation for the use of the record. Failure to obtain permission of the court and to lay a foundation for the use of the record does not vitiate the evidence, provided that the record satisfies the conditions under which a document may be used to refresh memory.”
