[26] I find that the content of both Exhibits 9 and 10 are electronic real evidence. On this point, I reference the decision of Justice Wood in Saturley v. CIBC World Markets Inc., 2012 NSSC 226. The exhibits are intended to show the electronic data stored on the phone of the accused at the time of his arrest. The evidence is compliant with s.31 of the Canada Evidence Act and therefore admissible. The ultimate use of this evidence requires further assessment in the context of all of the evidence offered at trial.
