[122] In my opinion, the LGBTI community is a discernible “community” of the kind that Parliament intended should be permitted to give voice to its collective loss as a victim. Mr. Lewis as spokesperson for the community in this case is an appropriate choice. To bring the court some sense of the collective loss to the LGBTI community consequent to Raymond Taavel’s death, Mr. Lewis has presented the court with the community magazine “Wayves” and a YouTube video. In my opinion, these are an appropriate means of presenting the court an insight into the collective loss of that community. To the extent that portions thereof stray into impermissible commentary, I will disregard those portions. Most significant is, as the Crown asserts, not the content thereof, but the mere fact of their creation and the collaboration required to give that community its public voice regarding their loss.
