Regina v. Riordan, 1973 CanLII 1378 (NS CA)
The statement must be a false statement of fact and not merely the vendor's incorrect opinion as to quality; it must be more than mere extravagant advertisement or puffery: 10 Hals., 3rd ed., p. 825. Section 319 (2) of the Criminal Code states:
319 (2) Exaggerated commendation or depreciation of the quality of anything is not a false pretence unless it is carried to such an ex tent that it amounts to a fraudulent misrepresentation of fact.
Sam Slick, the clock-peddler created 150 years ago by Mr. Justice Thomas Chandler Haliburton, would certainly recognize this often fine distinction between his "soft sawder" and out right lies
